The deal, in plain English
By building a castle you’re agreeing to a few common-sense things. We kept this short because nobody reads the long ones, including us.
What you’re buying. A private photo castle for the people you invite, for one year. There are two ways to buy it, and you choose at checkout:
For yourself. A yearly subscription. It renews automatically at the same price, we email you before every renewal, and one click cancels it — no phone call, no questions, no problem.
As a gift. One charge, one year, and we never touch your card again. It does not renew. There is nothing to cancel. Nobody should discover a charge a year later on a present they’d forgotten buying, so we don’t make that possible.
The money-back promise. If your circle doesn’t take to it, tell us within 30 days and we refund the whole thing. No interrogation, no “retention specialist.” If the ritual doesn’t stick, you shouldn’t pay for it.
If you decide not to renew. Your castle goes quiet rather than vanishing. Everyone can still look; nobody can add. Members’ QR Codes stop working after about 45 days, you and admins may continue looking for 90, and at 90 days it closes — only a renewal opens it again. We keep the photos for a year from the day it lapsed, so there is time to change your mind. Nothing is deleted automatically before then.
Your castle, your rules — within reason. You’re the keeper. You invite people, you can remove them, and you can give anyone else the run of the place alongside you. If you bought the castle as a gift, you can hand ownership over outright — that’s the whole point of a gift. If you bought a subscription for yourself, ownership stays with you, because the subscription belongs to the card paying for it; share the work, keep the crown. Be decent to the people you invite; they’re your family and friends, so this shouldn’t be hard.
What belongs to whom. Your photos are yours. You’re just letting us store and show them to your castle so the thing works. We don’t claim to own your memories — that would be weird.
The one hard line: keep it clean.
This is a family photo castle. If someone uploads nudity for prurient
reasons — the kind of thing the late Justice Potter Stewart had in mind when
he said of obscenity, “I know it when I see it” — we will know it when we
see it, and we will close that castle. No refund, no appeal, no second
castle. You forfeit what you paid. However, we’re not the morality police
about a baby in a bathtub or that spicy beach vacation; we’re talking about
the stuff you already know we mean. Don’t, and this clause never matters to
you. (Fear not, we can usually block questionable images before they even
land in your castle.) We do have the Boorish Uncle Clause: if some
nitwit uploads something beyond good taste, we won’t close the castle down
— we will, however, block that chowder-head’s account. You can dispense
your own brand of justice on them later.
Things we can’t promise. We work hard to keep your castle up and your photos safe, but we’re a small operation, not a bank vault. Keep your own copies of photos that would break your heart to lose. Stuff happens to every online service eventually; we’ll do right by you when it does, but we can’t promise the internet will never have a bad day.
If we ever have to say goodbye. We can close an account that breaks these terms (see: the one hard line). If we ever shut the whole service down, we’ll give you fair warning and a way to get your photos out first.
Boring necessary bit. This service is provided as-is, and to the extent the law allows, our liability is limited to what you paid us. We’re a photo album, not a party to your family drama.
